In 2002, N. V. (Nick) Mackey had a time-worked-disagreement with Charlotte-Mecklenburg Police Department. Before it could be settled Mr. Mackey's resigned to finish his law degree. Neither party pursued the matter. That would seem to say the matter wasn't serious.
On December 6th Mr. Mackey is elected sheriff by the Mecklenburg County Democratic Committee. As a former policeman and attorney he has the right resume. But how he was elected and some of his history becomes headlines. The 2002 disagreement with CMPD is questioned but neither Mackey nor CMPD will speak.
At first glance it appears Mr. Mackey's problems were nothing more than the kind of time record keeping errors that happen between employee and employer. It might have been the kind of problem that is never satisfactorily resolved: both parties feeling the other is wrong. After reading the Wake County court records it is possible to arrive at several conclusions that aren't favorable to Mr. Mackey or CMPD.
The above link to court records on Internet sheds a little light.
In a nutshell, two CMPD sergeants were investigated for how it came to be that Sgt. Mackey was credited with being on duty while he was absent. As reported by the court, citing CMPD Chief Darrel Stephens' memorandum, Sgt Thomas Atchison made false records of Mackey's time. This happened "multiple times."
The summary of these records became available public when Mr. Atchison applied for a North Carolina private investigator's license. He was first denied. He appealed to Wake County court. The court recommended he be given his license because he cooperated with the court. In doing so the judge said…….
The North Carolina Private Protective Services Board followed the court's recommendation. Mr. Atchison received his license.
Note #1: Mr. Mackey won the appointment to be sheriff "fair and square" as he has said. I don't know Democrat party politics but getting Democrats to agree to anything is an accomplishment. So on that account he has proven himself talented.
Note #2: It is noted here that the court records could reflect unfavorably on the CMPD. While Mr. Mackey hasn't spoken about this, Sergeant Atchison indicates all that happened was part of the CMPD culture.
Note #3: Mr. Mackey has said, "I will do all that I can to faithfully fulfill that responsibility and be worthy of that trust." Given what is reported in the court document, I would like to hear his response to Chief Stephens' testimony before believing the "trust" part of Mr. Mackey's statement.
Final note: I don't know Mr. Atchison but hope he is doing well.

"Petitioner's proven indiscretions do not constitute the lack of good moral character and temperate habits necessary to deny his application to become a private investigator. While his career as a law enforcement officer with the CMPD has ended, he is entitled to a second chance."
